Please note that this Privacy Policy does not apply to third parties, including, without limitation, entities that imaware does not own or control, such as third party sites that may have a link to or from the Site.
The Site is intended for a general business audience and is not directed to individuals that are considered minors who are not eligible under state law to use our services. imaware does not knowingly collect personal information from individuals considered minors under applicable state law. If you are under 18 years of age, you may not use the Site. If we learn that we have collected information from an individual under age 18, we will take steps to remove that information as quickly as possible unless permitted by applicable state law.
imaware may collect both personally identifiable information (“PII”) as well as non-personally identifiable information (“Non-PII”) when you visit the Site or contact us via the Site.
3.1. Personally Identifiable Information. PII means information that would allow a third party to identify or locate a particular person. PII includes, without limitation, your full name, email address, zip code, telephone number, birth date, and credit card number. imaware only collects PII if that information is voluntarily provided by you.
3.2. Non-Personally Identifiable Information. Non-PII means anonymous information that does not allow a third party to identify or locate a particular person. You can visit the Site to read information about the Site and the services offered without revealing any PII. However, during your visit to the Site, imaware may collect Non-PII such as the activity of your browser when you are viewing the Site; your site path during your visit to the Site; demographic data; the amount of time you spend on the Site and general information regarding your Internet service provider and host. The Non-PII may be collected by imaware in several ways.
3.3 Logging of Your Activities on the Site. You can remove or block third party cookies and similar technologies by programming your Internet browser, but in some cases that may impact your ability to access certain portions of the Site.
imaware may use the PII and Non-PII (collectively “User Information”) it collects under this Privacy Policy as follows:
5.1. imaware may use and disclose the User Information you share with imaware to manage your account, to fulfill your requests for products, programs and services, to respond to your inquiries about imaware’s offerings, to respond to your comments or requests for information, to improve the services that imaware offers to its users, to offer you other imaware products, programs or services that imaware believes may be of interest to you, to enforce the legal terms that govern your use of the Site, and for the purposes for which you provided the information. imaware may transfer your PII to third parties to whom you ask us to send such information under a written authorization and release. imaware may use and disclose your PII to conduct research or allow others to do so, but only if you provide written consent to the use of such information for this purpose.
5.2. imaware will not rent, share, or sell the PII you share with us to third parties for marketing purposes. imaware may share your PII with third parties for the purpose of assisting imaware with the management, operation or administration of the Site and associated services; the analysis of the performance of the Site; and the provision of imaware products and services (including, without limitation, the processing and serving of email and other electronic communications).
5.3. If a comment or request is made by email, imaware may respond by sending an email response back to the sender. imaware may store the emails received by imaware for archival purposes and also for marketing purposes. If you do not wish to receive email communications, you may unsubscribe by clicking on the “unsubscribe” link in a imaware email communication or emailing us at support@imaware.health. You may request your information to be deleted from imaware’s records, but please note that even if you have requested that your information be deleted, imaware may retain a record of certain information as required by law and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete your User Information, it will be deleted from the active database, but may remain in our archives and we may also retain de-identified information about your use of our Site and the services. Once we disclose your User Information to third parties as permitted, we cannot access that information any longer and cannot force the deletion or modification of any such information by the receiving parties to whom we have made those disclosures.imaware may disclose the User Information it collects on the Site under the following circumstances:
5.4. imaware reserves the right to access, read, preserve, and disclose any or all User Information as we reasonably believe is necessary to: satisfy any applicable law, regulation, legal process or governmental request; enforce our Terms of Use, including investigation of potential violations thereof or hereof; detect, prevent, or otherwise address fraud, security or technical issues; respond to user support requests; protect or defend our legal rights, property or safety, our users and the public. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.
5.5. If imaware sells all or a part of its business or makes a sale of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, then as part of the applicable transaction, imaware may transfer your User Information to the party or parties involved in the transaction. imaware may also share and/or transfer your User Information to any or all of its affiliated entities (such as any subsidiary or parent).
imaware has in place physical, electronic and operational security methods to help protect against unauthorized access to your User Information. Despite our best efforts to protect your User Information, no transmission over the Internet and no data storage method can be guaranteed to be safe 100% of the time. If you authorize disclosure of your information by imaware to other third parties, different privacy and security standards may apply to the third party and their use and disclosure in that context. imaware does not guarantee that its security measures or those of any third parties will not be circumvented or breached or that your User Information will not be accessed by a third party that is not authorized by imaware. imaware is not responsible, and assumes no liability, for any direct or indirect damages as a result of such circumvention or breach by any third party.
imaware may from time to time amend this Privacy Policy to reflect changes in imaware’s practices and services. If imaware makes any material changes to the way imaware collects, uses, or shares your User Information, imaware will notify you of those changes via a posting on the Site or an electronic communication to you which notice will also indicate the effective date of the posted changes.
